4.1 Ownership

You retain ownership of content you create and submit to DrawSpark, including:

4.2 License to DrawSpark

By submitting content to DrawSpark, you grant DrawSpark a worldwide, non-exclusive, royalty-free license to:

• Display, store, and distribute your content on the Service
• Allow other users to view, like, favorite, and interact with your content
• Use your content for promotional purposes (with attribution)

4.3 Content Standards

You agree not to submit content that:

• Is illegal, offensive, or harmful
• Infringes intellectual property rights
• Contains malware or malicious code
• Violates others' privacy
• Is spam or repetitive content

5.1 Nature of AI Content

Drawing ideas generated by DrawSpark's AI are suggestions only. DrawSpark does not guarantee:

• The accuracy or originality of generated content
• That generated content does not resemble existing copyrighted works (AI outputs are based on training data and may coincidentally resemble existing works)

5.2 No Professional Advice

AI-generated drawing ideas are for inspiration and entertainment purposes only. They are not professional advice, instruction, or guarantees of creative outcomes.

5.3 Ownership of AI-Generated Output

You may use, modify, and create derivative works from AI-generated drawing ideas without restriction. DrawSpark claims no ownership over AI-generated outputs.

6.1 DrawSpark's IP

DrawSpark owns all rights to:

• The DrawSpark brand, logo, and trademarks
• The website design, code, and user interface
• The AI model integration and backend systems

6.2 User-Generated Content

Users retain ownership of their original content as described in Section 4.

You agree NOT to:

• Scrape or crawl: Use automated systems to access DrawSpark beyond rate limits
• Bypass rate limits: Attempt to exceed the 30 generations per day limit
• Generate harmful content: Use DrawSpark to generate offensive, illegal, or harmful material
• Impersonate others: Create accounts pretending to be someone else
• Disrupt the Service: Attempt to damage, disable, or impair DrawSpark's infrastructure
• Reverse engineer: Attempt to extract source code or API implementation details

DrawSpark is provided "as is" and "as available" without warranties of any kind.

DrawSpark does not warrant that:

• The Service will be uninterrupted, secure, or error-free
• AI-generated content will be original, accurate, or useful
• The Service will meet your specific needs or expectations

To the maximum extent permitted by law, DrawSpark is not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from reliance on AI-generated content
• Damages exceeding the amount paid (DrawSpark is free, so $0)

You agree to indemnify DrawSpark against claims arising from:

• Your violation of these Terms
• Your content or use of the Service
• Your infringement of third-party rights

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
